​1. Introduction

Welcome to Pixel Planet . These Terms and Conditions (“Terms”) govern your use of our website, online booking platform, and participation in our on-site experiences, including the Pixel Grid and Virtual Reality (VR) Simulators (collectively referred to as “Services”).

  • By booking a session online, purchasing a ticket, or participating in any of our activities, you acknowledge that you have read, understood, and agree to be bound by these Terms.

  • If you do not agree, please do not use our Services.

  • By purchasing a ticket, you agree to these Terms and Conditions.​

2. Our Services

Pixel Planet provides interactive entertainment experiences, including:

  • Pixel Grid: A light-up, motion-based floor grid that involves running, teamwork, and physical coordination.

  • VR Simulators: Immersive virtual reality experiences involving visual and physical engagement using VR headsets and controllers.

  • We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice.​

3. Age Restrictions

To ensure participant safety and enjoyment :

  • The Pixel Grid is open to guests aged 4 and above.

  • The Virtual Reality Simulators are open to guests aged 8 and above due to health, safety, and

        eyesight-development considerations.

  • Children under 16 must be accompanied by a responsible adult at all times.

  • Pixel Planet staff may request proof of age when necessary.​

4. Safety and Participation

Your safety is our top priority.

  • By participating, you acknowledge and agree that you will follow all safety instructions provided by Pixel Planet staff.

  • You are in good health and physically capable of participating in our experiences.

  • You understand that activities like the Pixel Grid involve physical movement and running, which carry a small risk of injury.

  • You understand that VR experiences can cause dizziness, nausea, or motion sensitivity in some users.

  • You will immediately notify staff if you experience discomfort or wish to stop participating. Pixel Planet reserves the right to refuse entry or stop a session if staff believe participation could pose a health or safety risk .

  • Participants with medical conditions such as epilepsy, heart issues, motion sickness, or balance disorders should consult a doctor before taking part. 

  • By using our services, you assume all risks, including serious injury or death.

  • ​By participating, you also agree to the terms outlined in our Participation Agreement & Waiver available online and at the venue.

5. Booking, Payments, and Cancellations

  • Bookings can be made online through our website or in person at our venue.

  • Payment is required at the time of booking to secure your time slot. Walk-ins are welcome, subject to availability.

  • Cancellations must be made at least 24 hours in advance of your scheduled booking time. Cancellations made less than 24 hours before the booking will incur a 50% cancellation fee, calculated based on the total booking amount.

  • No-shows or late arrivals may result in forfeiture of your session without refund.

  • Pixel Planet reserves the right to cancel or reschedule bookings for operational reasons, in which case customers will be notified and offered an alternative time or refund.​

6. Conduct and Behaviour

We want everyone to have fun safely.

  • Therefore you must act responsibly and treat staff, other guests, and equipment with respect.

  • Running outside designated areas, rough play, or intentional misuse of equipment is strictly prohibited.

  • Any damage caused by negligent or reckless behaviour may result in the participant being held responsible for repair or replacement costs.

  • Pixel Planet reserves the right to remove anyone from the premises for unsafe or inappropriate behaviour without refund.​

7. Equipment Use and Liability

All equipment (including VR headsets, controllers, and Pixel Grid components) remains the property of Pixel Planet.

By participating, you agree to:

  • Use all equipment safely and only as instructed.

  • Follow all staff directions at all times.

  • Accept full responsibility for any damage or injury caused by misuse, rough play, or failure to comply with safety instructions.                                                     

Pixel Planet is not liable for :

  • Personal injury resulting from failure to follow safety instructions;

  • Loss or damage to personal belongings;

  • Any indirect, incidental, or consequential damages arising from participation or inability to participate.

  • Liability for gross negligence or intentional misconduct by Pixel Planet is not excluded.

8. Media and Photography

  • Pixel Planet may take photos or videos for promotional purposes.

  • By entering our premises, you consent to the possible use of your image or likeness for marketing materials, unless you notify staff otherwise prior to participation.

9. Intellectual Property

  • All branding, designs, and materials associated with Pixel Planet (including the Pixel Grid system, logos, graphics, and other media) are owned by or licensed to Pixel Planet and protected by applicable copyright and trademark laws.

  • You may not reproduce, distribute, or use any content without prior written permission.

10. Privacy

We collect, use, and store personal information in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy.

This includes information you provide during online booking or in-store (such as your name, contact details, and payment information).

By using our Services, you consent to the collection and use of this information for purposes including:

  • Managing and confirming your booking

  • Ensuring safety and compliance with our Participation Agreement & Waiver

  • Communicating with you about your session or any necessary follow-up

  • Improving our services and customer experience

All personal information is stored securely and protected against loss, unauthorised access, or misuse.

Pixel Planet will never sell your personal information.
Information may only be shared with third parties where:

  • It is required to process your booking or payment

  • We are legally required to do so

  • You provide explicit consent

You have the right to access and request correction of your personal information at any time by contacting us at info@pixelplanet.co.nz.

11. Disclaimers

  • Our Services are provided “as is” and “as available.”

  • Pixel Planet makes no guarantees that our website or equipment will always operate without error or interruption.

  • Participation in physical or VR activities is at your own risk.​

12. Limitation of Liability

  • To the maximum extent permitted by New Zealand law, Pixel Planet and its employees shall not be liable for any injury, loss, or damage resulting from your use of our Services, except where caused by our proven negligence.​

13. Indemnification

  • You agree to indemnify and hold harmless Pixel Planet, its owners, and staff from any claims, damages, or expenses arising from your breach of these Terms or misuse of our Services.​

14. Governing Law

  • These Terms are governed by and construed in accordance with the laws of New Zealand.

  • Any disputes shall be resolved exclusively in the courts of New Zealand.​
