1. Acknowledgment of Activities

I, the undersigned participant (or parent/guardian if applicable), understand that participation in activities at Pixel Planet, including the Pixel Grid and Virtual Reality (VR) Simulators, involves physical movement, immersive digital environments, and sensory stimulation.

Activities may include, but are not limited to:

• Rapid or unexpected visual and audio effects

• Full- or partial-body movement

• Balance challenges

• Motion simulation

• Immersive VR experiences that may feel realistic

I understand that activities may be modified, suspended, or unavailable at Pixel Planet’s discretion.

2. Assumption of Risk

I acknowledge that participation involves inherent risks, including but not limited to:

• Dizziness, nausea, or motion sickness

• Disorientation or loss of balance

• Trips, slips, or falls

• Collisions with objects or other participants

• Photosensitive or sensory reactions (including potential seizure triggers)

• Muscle strain or physical discomfort

• Aggravation of pre-existing medical conditions

• Minor or serious injury

I understand that these risks may arise from my own actions, other participants, equipment use, or the environment.

I voluntarily assume these risks to the fullest extent permitted by law.

I confirm that I will follow all staff instructions and remove myself from participation if I feel unwell or unsafe.

Participant Responsibility:

• All participants must exercise caution and follow staff instructions at all times while using the Pixel Grid.

• The Pixel Grid is a barefoot experience for safety and to protect the interactive floor surface.

• Pixel Planet is not responsible for injury, loss, or damage arising from failure to follow staff instructions, unsafe behaviour, or use of unsuitable footwear, to the extent permitted by New Zealand law.​​

I confirm that I have disclosed any medical conditions that could increase my risk and will follow staff instructions, removing myself from the activity if I feel unwell or unsafe.

I understand that while I assume these risks, Pixel Planet remains responsible for proven negligence as permitted under New Zealand law.

3. Health & Safety Confirmation

I confirm that:

• I am physically able to participate in these activities

• I do not have medical conditions that may increase my risk (e.g., seizures, heart issues, severe motion sickness)

• I will notify staff immediately if I feel unwell or unsafe

• I will follow all instructions from Pixel Planet staff

4. Food & Drink Policy

• No food or drink is allowed near or on the equipment

• Pixel Planet reserves the right to ask participants to store or dispose of drinks before entering

5. Dress Code ​​

• For safety and consistency with Pixel Planet’s Footwear Policy:

• The Pixel Grid is primarily a barefoot experience

• Closed-toe shoes may be permitted if clean, dry, and free from debris, at staff discretion

• Socks alone are not recommended due to slip risk

• High heels, open-toed shoes, flip-flops, or unsafe footwear are not permitted

• Clothing must allow free movement and avoid hazardous accessories

• Pixel Planet reserves the right to refuse participation if footwear or clothing is deemed unsafe.

 

6. Personal Belongings

• Pixel Planet is not responsible for loss, theft, or damage of personal belongings

• It is recommended to store items safely and not take them onto the Pixel Grid or VR areas

• Loose items may pose safety hazards and may be required to be removed before participation

7. Group Booking Clause

• The Group Organiser must ensure all participants have signed this waiver

• The Group Organiser is responsible for communicating all safety rules to their group

• The Group Organiser assumes liability for any guest participating without a completed waiver

• Cancellation & refund policies apply to all participants, unless otherwise agreed at booking

8. Accuracy of Information

I confirm that all information provided, including age, medical disclosures, and contact details, is accurate.
Pixel Planet is not liable for injuries or issues arising from false or incomplete information.

9. Data Use Consent

By signing this waiver, I consent to Pixel Planet:

• Collecting and securely storing my personal information (contact details, participation records)

• Using my information for safety, booking management, and communication

• Contacting me for follow-ups if needed

I understand my data will not be sold to third parties. I may request access or deletion as allowed by law.

For participants under 18, parents/guardians consent to the collection and use of personal information for participation purposes.

10. Release of Liability

To the maximum extent permitted by New Zealand law, I release Pixel Planet, its owners, employees, and affiliates from liability for loss, injury, or damage arising from participation in activities, except where such liability cannot legally be excluded (including liability for negligence causing death or personal injury).

I agree that I will not bring claims for risks that are inherent to participation in the activities or that arise from failure to follow staff instructions.

11. Equipment Responsibility

I agree to:

• Use equipment safely and responsibly

• Follow all instructions from staff

• Refrain from misuse, roughness, or intentional damage

• Accept financial responsibility for damage caused by improper use

​

12. Photo/Video Release

I give permission for Pixel Planet to take photos or videos of my participation for promotional, safety, or training purposes, unless I notify staff otherwise.

​

13. Minors

• Children under 12 must be actively supervised by a responsible adult at all times while on the premises. Drop-offs are not permitted.

• The parent/guardian acknowledges and accepts the inherent risks of participation, including the risk of injury.

​

14. Cancellation & Refund Reference

• Participation fees are subject to Pixel Planet’s Cancellation & Refund Policy, including 50% fees for cancellations less than 24 hours and no refunds for no-shows or late arrivals

​

15. Governing Law

These terms are governed by New Zealand law, consistent with Pixel Planet T&Cs.
